Extensions Granted for some Round Exclusions

The USTR announced new extensions to 16 product exclusions found on Set 5 of the Section 301 tariffs. The previous expiration date of June 4, 2020 has been extended to December 31, 2020; they have been assigned provisional tariff 9903.88.50. Products not granted an extension will be eligible for the 25 percent additional duties on June 4.

Please note that if you have any products currently excluded under 9903.88.10 you should look over this new list.

The USTR giveth and the USTR taketh away

In what was termed a technical amendment, the USTR deleted exclusions granted to two products found on Round 4A. The products, which were originally granted an exclusion on May 6, 2020 (Set 28), are listed below.

  • Tumblers or disposable graduated liners for plastic pitchers used in healthcare facilities (described in statistical reporting number 3924.10.4000)
  • Manually operated plastic pill or tablet crushers presented with attachable pouches of plastics for capturing and storing the resulting powders (described in statistical reporting number 8479.82.0080)

BEWARE of Exclusion Expirations

As of today, the USTR has issued 29 sets of exclusions to Section 301 tariffs – each list has an expiration date. Four of these sets have already expired with another due to expire June 4.

While extensions have be granted to some of the published exclusions, the vast majority of the exclusions were allowed to expire. The expiration of an exclusion results in the return of the 25 percent additional tariffs for the product.

The pace of these expirations is about to pick up significantly.

Between June 4 and August 7, 2020 there are 17 more exclusion sets scheduled to expire. This will cover most of the exclusions granted to products found on Round 3 and will include all exclusions covering furniture and lamps. While extensions are possible, the percentage of products granted an extension is very small.
