The latest China tariffs have been announced and will become effective August 23, 2018, completing $50 billion in tariffs. This list comes after comments and exclusions were made to List 1 and also thereafter to List 2. Filing comments to List 3 would be wise to seek exclusions on Lists 1 and 2 as permitted.
1) On August 1, 2018, US Trade Representative (USTR) Robert Lighthizer published notice consideration was being given that the rate of duty which would apply to the products on the China 301 List 3 would be raised from 10 percent to 25 percent. As a result, the “written comment period” would be extended to September 5, 2018. While the deadline to request to appear at the public hearing is changed to August 13, 2018, the hearing itself is still scheduled for August 20, 2018 to August 23, 2018.
2) On August 2, 2018, the USTR clarified the August 17, 2018, deadline for initial comments had also been extended to September 5, 2018.
3) In the Federal Register published on August 7, 2018, the written comments deadline was again changed, this time to September 6, 2018.
4) Then, on August 7, 2018, USTR also issued notice that the 25 percent proposed tariff against goods on List 2 would become effective August 23, 2018. (JOC, 2018).
